Conditions for rental

Conditions for rental

  1. The Floating Room is available for rental for corporate entities and/or private individuals aged 18 years or older.
  2. All prices displayed are subject to change without notice before a booking is confirmed.
  3. The person making the booking is classed as the “Renter” in any booking which includes more than one person. The Renter guarantees that the Renter has the authority to accept these terms on behalf of the corporate entity and/or each member of your group using The Floating Room.
  4. The Renter is the primary contact with The Floating Room and accepts any communications/correspondence from The Floating Room on behalf of the corporate entity and/or any group using The Floating Room in the period booked.
  5. At the time of booking, the Renter must provide The Floating Room with all relevant details, e.g. name(s), e-mail address(es), phone number(s), address(es), billing address(es), billing information(s) etc.
  6. Any otherwise applicable law regarding refunds/returns of online purchases within 14 days does not apply to the rental of rooms, boats and/or fleets and, thus, does not apply to bookings of The Floating Room. Please read the cancelation policy below for details on how you may cancel or reschedule a booking of The Floating Room.

Requirements upon arrival

  1. Valid passport or picture ID.
  2. Mobile telephone fully charged is essential onboard. It will have to be switched on during the entire duration of your journey to allow for communication with The Floating Room and/or relevant authorities in any case (any emergency).
  3. Confirmation e-mail of your booking.
  4. If you do not appear to possess the correct documentation or do not meet all relevant requirements of these Use Terms, you will not be allowed to rent our boats.

Liability and insurance

  1. The Floating Room is insured but the Renter is the primary responsible for any damage to or loss of the boat and/or its equipment. The Renter will be held responsible for the actions of any other members of your group as well.
  2. We highly recommend that you have adequate personal insurance cover in case of loss of property and/or injury.

Cancellations Policies

  1. The cancellation policy described in the following sections 2 through 6 apply to all customers.
  2. When you trade with The Floating Room as a private client, you can cancel your booking up to 10 days before your reservation. 240 hours prior to the reservation starts your purchase becomes non-refundable as the purchase is considered consumed and you acknowledge that you lose your right to a refund.
  3. If you cancel your purchase with The Floating Room more than 240 hours before your reservation starts, you can choose to i) receive a voucher with the full amount (valid for 1 year – the date of expiration can be found on the voucher), ii) change the booking date at no cost or iii) receive a refund of your balance within 14 days from the date we received your cancellation.
  4. To exercise the right to the refund you must notify us of your decision to cancel by an unequivocal statement, e.g. letter sent by email to info@thefloatingroom.dk specifying your name, email and the unique booking code for the reservation we have provided to you. In order to receive a voucher with the full amount, you must click the link in your booking confirmation email. Here you can cancel or change your booking. A voucher will be sent to you within minutes.
  5. If you are eligible for a refund, the amount will generally be returned automatically to the payment card you originally used to pay the order. Alternatively, we will contact you and ask for your bank information. We will then need the following information: (i) name of the bank, (ii) registration number (4 digits), (iii) account number (10 digits).
  6. Please note that gift cards and any kind of vouchers made are non-refundable. Otherwise applicable law regarding refunds/returns of online purchases within Europe of 14 days, does not apply to this.

Use of The Floating Room

  1. The Renter is responsible for the safe and responsible usage of The Floating Room and for any actions of any member in your group, guests or the like and you must take all reasonable care.
  2. In the event of damage to The Floating Room rendering it inoperable, regardless of the reason, no responsibility can be accepted by The Floating Room for loss of time and any other damages or expenses incurred as a result hereof. The Floating Room shall not be responsible for the consequences of any delay, restriction or cancellation of boat rentals arising from repairs or damage or other circumstances beyond its control.

General

  1. It is prohibited to throw any litter etc. into the water.
  2. Irresponsible behaviour, such as significant consumption of alcohol, is not allowed by any of the persons onboard The Floating Room.
  3. You are only allowed to pee on designated nearby toilets or on public toilets. It is strictly forbidden to pee on private property areas and/or onboard the boats.
  4. It is mandatory to respect the maximum number of persons permitted onboard The Floating Room to comply with laws and regulations: the number of persons indicated in the booking, or otherwise agreed with The Floating Room, may not be exceeded.
  5. The Floating Room is never to be left unattended unless securely locked using the lock provided by The Floating Room.
  6. At the end of the rental period, it is your own responsibility to ensure that you collect all your items of personal belongings from The Floating Room. The Floating Room is no liable for any loss of property.
  7. The Floating Room does not cover any expenses in case of cancellations due to weather conditions, theft, damages or the like; in case of bad weather or wind, depending on severity, planned hires may be delayed or cancelled (in this case they will be postponed to an available date).
  8. The Floating Room must not be used for commercial use without prior written permission from The Floating Room.
  9. The Floating Room may at any time refuse or terminate the rent agreement if these terms are breached.
  10. Events with alcohol consumption e.g. bachelor parties are not allowed. The Floating Room reserves the right to reject such groups/bookings/events before departure without any refund.

Payment

  1. All prices include VAT.
  2. Payment can be made using the following payment methods: Visa, Visa Electron, MasterCard, Maestro, JCB and American Express as well as Apple Pay and Google Pay, or by invoice.
  3. Rent or the purchase of beverages, drinks, snacks, meals etc. must be paid in advance.

Liability

  1. The Floating Room’s liability is limited to a maximum amount equal to the fees paid by the Renter under these terms.
  2. In no event shall The Floating Room be liable, whether in contract or tort, or otherwise for any incidental, indirect, consequential or unforeseeable loss, damage or expense, loss of profits, loss of business, loss of opportunity, loss or corruption of data, however arising, even if advised of the possibility of such loss or damages being incurred.
  3. The remedies provided in these Use Terms are the exclusive remedies of the Parties.

Gowering Law

  1. The laws of Denmark (excluding its conflict of laws provisions) shall govern the construction and enforceability of these Terms of Use. Any action arising under or relating to these Terms of Use shall lie within the exclusive jurisdiction of the Court of Copenhagen.

Consumer Complaints

  1. If you experience errors or defects in the delivery from The Floating Room, please feel free to contact us at info@thefloatingroom.dk so we can find a satisfactory solution.
  2. If it is not possible to find a solution, The Floating Room is subject to the Consumer Complaints Act from 1 October 2015, subject to the following alternative dispute settlement body:

The Floating Room's Privacy Policy

Personal data

  1. It is important for us to keep your personal data safe and confidential. We have procedures for collecting, storing, deleting, updating and disclosing personal data to prevent unauthorized access to your personal data and to comply with applicable laws.
  2. We ensure fair and transparent computing. When we ask you to provide us with your personal data, we will let you know what personal data we process about you and for what purpose such personal data is being processed. You will receive information about this at the time of collection of your personal data.
  3. The following guidelines describe the types of personal data we collect, how we process such personal data, and who you can contact, if you have any questions or comments about this Privacy Policy.

Costumer data:

  1. When you book a service of The Floating Room or otherwise receive The Floating Room services, we collect the following customer data about you: first name, last name, phone number, email and IP address. If you buy a gift card you may include the name for the receiver as well – this is not obligatory.

Booking data:

  1. We collect the following data about you: date, start time, end time point, price, amount paid, comments, location.

Other Personal Data:

  1. Additionally, we will automatically collect the following data in order to provide the The Floating Room service, which may include:IP Address

    OS Name & Version

    Browser Name & Version

    Screen Resolution

    Language (based on headers sent by browser)

    Usage Date & Time

    Usage Flow (e.g. which presentations/slides were opened and in which order, which emails were opened and which links in emails were clicked, duration of time spent on presentations and specific slides etc.)

    Heat map (e.g. tracking of exactly what was clicked during the usage session, including links, images, selected areas of text etc.)

Purpose:

  1. We collect and store your personal data for specific purposes or other legitimate business purposes.
  2. Your personal data is collected and used for:

    - To provide you with The Floating Room service information about services offered on or through The Floating Room and evaluations of these – the contract between you and The Floating Room – as per Article 6 b&c of the Data Protection Regulation.

    - Here we collect “Customer data”, “Booking data” to adhere to book keeping rules up to 5 years and “Other personal Data” as described above to improve our services for 1 year.

  3. News about The Floating Room and to conduct research about The Floating Room's customer base or services – the permission you give The Floating Room – as per Article 6 a of the Data Protection Regulation.

    - Here we collect “Customer data”, “Booking data” to adhere to book keeping rules up to 5 years and “Other personal Data” as described above to improve our services for 1 year.

    - Furthermore, we ask for demographic and interest data which are not obligatory to provide us with when you sign up for our newsletter (birthday, demographic data, your interests etc.). We store this for as long as you are signed up for the newsletter. In all newsletters from us you can at any time withdraw your permission.

  4. To fulfil your reservation and purchase requests and payments including credit checks and collection – the contract between you and The Floating Room – as per Article 6 b&c of the Data Protection Regulation.

    - Here we collect “Customer data”, “Booking data” to adhere to book keeping rules up to 5 years and “Other personal Data” as described above to improve our services for 1 year.

  5. to notify you of technical updates or changes in policy – the contract between you and The Floating Room – as per Article 6 b&c of the Data Protection Regulation.

    - Here we collect “Customer data”, “Booking data” to adhere to book keeping rules up to 5 years and “Other personal Data” as described above to improve our services for 1 year.

  6. In case of a contractual agreement between a company (not the employees) and The Floating Room, The Floating Room can collect the same data as in 2.1, 2.3 and 2.4 based on the basis of legitimate interest.
  7. We may use non-Personal Data to analyse and develop our marketing strategy and further improve The Floating Room and our services.

Data Quality:

Required Personal Data

  1. We verify that the personal data we process about you is correct and not misleading. We also make sure to update your personal data on a regular basis. We ask you to provide us with relevant changes to your personal data. You can use the contact details above to notify us of such changes.
  2. Your personal data will always be processed in accordance with good data processing practices (“God Databehandlingsskik”) and in accordance with applicable laws.
  3. Please note that: (1) there might be some latency in deleting this personal data from our servers and back-up storage, and (2) we may retain this personal data if necessary to comply with our legal obligations, resolve disputes, or enforce our agreements.

Data Quality Policies:

Activation

  1. We collect Personal Data from the Data Subject when you book/activate the service we provide and when you and the Data Subject uses The Floating Room.

    Visit on our website:

  2. When you visit The Floating Room's website, we collect “Other personal data” as described above and we also collect non-Personal Data, which is information that by itself cannot be used to identify or contact you, such as demographic information (e.g. age or gender) or usage information (e.g. the browser you are using, the URL that referred you to The Floating Room and the areas of The Floating Room you visit). We may also supplement the information we collect with information from other sources to assist us in evaluating and improving our Platform and offerings.

    Newsletter:

  3. If you sign up to receive The Floating Room's newsletters, your personal data is registered directly with The Floating Room and our email marketing service Mailchimp and Active Campaign. If you no longer wish to receive newsletters from The Floating Room, you can unsubscribe at the bottom of all emails sent (or by sending an e-mail hereon to info@thefloatingroom.dk).
  4. You allow us to create custom audiences in social media based on your email-address through email upload. This is to improve our advertising relevense to you.

    Anonymization:

  5. The Floating Room applies anonymization of data from customers for statistic and research purposes, as well as to improve systems, processors and products.
  6. The Floating Room irrevocably anonymizes Personal Data in such a way that the Data Subject can no longer be identified after the deletion as described under purpose.
  7. For example, name, address or personal identification number will be replaced by a code, serial number, etc. Codes are assigned randomly and cannot be restored using lists, keys, etc., showing the relationship between the serial number and the actual identification information.

Tranfer:

General

  1. We may disclose Personal Data to other companies or people under any of the following circumstances:

    - If sharing the information is reasonably necessary to provide or otherwise make available The Floating Room and any feature of The Floating Room or a service that you have requested.

    - If we are required to do so by law, in connection with litigation, to prevent a crime, or to protect personal property, the public, or The Floating Room.

    - In connection with a sale or merger with another entity, consolidation, restructuring, sale of company assets, financing or other corporate change, including during the course of any due diligence process or if The Floating Room should ever file for bankruptcy or related proceeding.

    - When we otherwise have the Data Subject’s consent to share the information.

    - The Floating Room may also share non-Personal Data with third parties (e.g. aggregate or demographic data).

Disclosure For Legal Reasons

  1. We disclose Personal Data to companies, organizations or individuals outside of our group of companies if we believe in good faith that access, use, preservation or disclosure is necessary to: (1) comply with applicable law, regulation, legal process or enforceable governmental request, (2) enforce applicable user terms, including investigation of potential violations, (3) register, prevent or otherwise protect against address fraud, security or technical issues, or (4) indemnifying us, our users or the public’s rights, property or safety, as required.

Data Subject Rights:

Objection

  1. You have the right to object to our processing of your personal data. You can also object to our disclosure of your personal data. You can use the contact information at the top of the Privacy Policy to send an objection to us. If your objection is justified, we will stop any processing of your personal data.

Insight, Etc.

  1. If you contact The Floating Room, The Floating Room will inform you of what personal data of you The Floating Room is processing, the purpose of the processing, who receives the personal data and the information om where from the personal data originates. We will reply to your request as soon as possible. If your request has not been answered within 4 weeks of receipt, The Floating Room will inform you of the reason for this and when a decision is expected to be available. Any inquiry about the above will only be answered if more than 6 months have elapsed since your last request unless you can demonstrate a particular interest in getting the information earlier.

Correctness of Data

  1. The processing of your personal data will be organized so that the information can be updated when needed. Information that proves inaccurate or misleading will be promptly rectified or erased. You are responsible for providing us with information to help ensuring the correctness of your personal data.

Right of Access

  1. Upon your written request, we will provide you with information on whether or not we process personal data concerning you. We will also provide you with information on 1) what information is processed, 2) the purposes, 3) the categories of recipients of the personal data and 4) available information about the source of the personal data.
  2. We will provide such information to you within 4 weeks from the date of receipt of your request. If we cannot provide such information to you within the stated 4 weeks after the date of receipt of your request, we will provide you with information of the reason for this and the time when the information is likely to be available.

Sub data processor:

  1. We use third party data processors to perform the technical operation of The Floating Room. Sub data processing is carried out within the European Union. One sub processer, MailChimp is in the USA. The contract between The Floating Room and MailChimp has included a standard contractual clause based on the requirements by the European Commission (GDPR). Please contact The Floating Room for the contract. The database server is hosted in its own isolated environment protected by a firewall, which prevents the data from being directly accessible to any external party. The majority (database & main server) of our data is stored within the European Union, primarily in Ireland.
  2. We use the following sub data provider types:

    - Technical data base provider
    - Email marketing provider
    - Payment processesing provider
    - Heatmap and screen recording provider
    - Statistics and website usage provider

  3. The sub data processors act solely on our instructions which are based on your instructions. The sub data processors have taken the necessary technical and organizational security measures to protect data against accidental or unlawful destruction, loss or alteration and against the unauthorized disclosure, abuse or other processing in violation of applicable law.

Changes:

  1. We may change our Privacy Policy at any given time. As a The Floating Room account holder you should review our Privacy Policy regularly. Such changes shall come into force immediately. If you do not agree to the modified Privacy Policy, please stop using The Floating Room. In the event of a conflict between this Privacy Policy and the modified terms, the modified terms shall apply. Your continued use of the Services provided by us after the date the modified terms are posted will constitute your acceptance of the modified Privacy Policy.
  2. The latest change of the policy was August 16th 2024.

Supervision:

The Danish Data Protection Agency, inter alia, supervises the compliance with the applicable national regulation on personal data. You can at any time complain to Datatilsynet. The contact information for the Danish Data Protection Agency is:
